We reserve the right to modify these Terms of Service at any time. When we do, we will update the effective date at the top of this page. Continued use of the website following any change constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

Orders & Account Responsibilities

Account security

Order acceptance & pricing errors
An order confirmation email confirms that we have received your order — it is not automatically our acceptance of it. A contract for the sale of goods is formed once we dispatch your order or send you a shipping confirmation. We reserve the right to refuse, limit, or cancel any order, including where we suspect fraud, where stock is unavailable, or where a product or price has been listed in error. If a pricing or listing error affects your order, we will contact you before proceeding — you may then choose to reconfirm at the correct price or cancel at no charge, with a full refund of any amount already paid.
Your suggestions & feedback
Any feedback, ideas, suggestions, or other input you voluntarily submit to Luxfi becomes our sole property. We may use such input for any purpose without acknowledgment or compensation to you. This does not affect any personal data you submit, which is handled in accordance with our Privacy Policy.

We collect certain personal data when you interact with our website in order to process your orders, communicate with you, and improve our service. Full detail on what we collect, why, and your rights is set out in our Privacy Policy — this section covers only how data protection law applies to your acceptance of these terms.
Germany & Austria — GDPR
If you are a customer resident in Germany or Austria, the General Data Protection Regulation (GDPR) governs our processing of your personal data. When you create an account or place an order, we process the necessary data on the legal basis of performing our contract with you (Art. 6(1)(b) GDPR), or, where applicable, on the basis of your consent or our legitimate interests. You retain the full set of GDPR rights — including access, rectification, erasure, restriction, portability, and objection — as described in our Privacy Policy.
Switzerland — FADP
If you are a customer resident in Switzerland, our processing of your personal data is governed by the Swiss Federal Act on Data Protection (FADP) rather than the GDPR. We apply comparable safeguards and honour equivalent data-subject rights for Swiss customers, as described in our Privacy Policy.
Returns, Refunds & Withdrawal Rights
We stand behind the quality of every Luxfi product. If you are not satisfied with your purchase, our returns and refunds process is designed to be fair, transparent, and to exceed the minimum protection required by law.

How to initiate a return
To request a return or raise a concern about your order, please contact us within 30 days of delivery at info@luxfi.de with your order number and reason for return. Full details are set out in our Returns & Refunds Policy.
EU statutory withdrawal right (14-day floor)
Under the EU Consumer Rights Directive (2011/83/EU), customers in Germany and Austria have a statutory right to withdraw from an order within 14 days of receipt, without giving any reason. This is a legal minimum, not a ceiling: Luxfi's own Returns & Refunds Policy gives you a full 30 days — more than double the statutory floor — and we extend the same 30-day guarantee to our customers in Switzerland as a matter of policy, even though Switzerland is outside the EU/EEA and the Directive does not itself apply there. Nothing in these Terms reduces, limits, or replaces your statutory withdrawal right; where the two differ, whichever is more favourable to you applies.
Liability & Indemnification
Please read this section carefully as it sets out important limitations on Luxfi's liability and your obligations in the event of a claim arising from your use of our website.
Limitation of liability
Luxfi's liability is limited to the maximum extent permitted by applicable law.
To the fullest extent permitted by law, Luxfi, Ecomvest LLC, its members, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, our website, products, or services.
This limitation applies to
Errors or inaccuracies in website content; interruptions or outages; unauthorised access to your data; third-party content or conduct; and any other matter relating to the website.
Swiss customers — Code of Obligations
For contracts with Swiss customers, formation (offer and acceptance) and liability for breach are additionally governed by the Swiss Code of Obligations (OR), including the seller's liability under Art. 97 OR unless it is shown the breach was not at fault.
EU & Swiss consumers: Nothing in this limitation of liability excludes or restricts liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under the mandatory consumer-protection law applicable to you in Germany, Austria, or Switzerland.
Indemnification
You agree to indemnify, defend, and hold harmless Luxfi, Ecomvest LLC, and their respective affiliates, officers, members, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of our website; (b) your violation of these Terms of Service; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit to the website.
Governing Law & Dispute Resolution
This section explains which law applies to these Terms and how disputes are handled — and, most importantly, confirms that your local consumer protections are never displaced by this choice.
Governing law
These Terms are governed by the law of the State of Wyoming, USA.
These Terms of Service, and any dispute arising out of or relating to them or your use of luxfi.de, are governed by the laws of the State of Wyoming, United States (Ecomvest LLC's state of formation), excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Your local rights always come first. Nothing in this governing-law clause limits, excludes, or waives any mandatory statutory consumer-protection right that you hold as a consumer resident in the European Union (Germany, Austria) or Switzerland under the law of your country of habitual residence. Those mandatory rights apply to you regardless of this clause. Where a conflict exists between these Terms and your local mandatory consumer rights, your local mandatory consumer rights prevail.
Online dispute resolution & consumer arbitration
The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr, which EU consumers may use to resolve disputes without going to court. Ecomvest LLC is not obligated, and is not currently willing, to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). You may still always exercise your statutory rights through the courts or authorities available to you under your local law.
Copyright & DMCA Notice
Because Luxfi is operated by Ecomvest LLC, a US company, and our website is hosted on US-based infrastructure, we honour the notice-and-takedown procedure of the US Digital Millennium Copyright Act (DMCA) for copyright complaints, in addition to any equivalent notice-and-takedown rights available to rights-holders under EU or Swiss law.
Submitting a takedown notice
If you believe content on luxfi.de infringes your copyright, send a written notice to info@luxfi.de including: (1) your signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location on our site; (4) your contact details; (5) a statement of good-faith belief that the use is unauthorised; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorised to act on the copyright owner's behalf. We will review valid notices and remove or disable access to infringing material as appropriate.

For customers resident in Germany, Austria, or Switzerland, your mandatory local consumer-protection rights apply in full, regardless of any provision of these Terms, and will always take precedence where a conflict exists.
